Fmr. Federal Prosecutor Says AOC ‘Skirting’ Legal Line Giving Advice to Illegals

Rep. Alexandria Ocasio-Cortez (D-N.Y.) is facing criticism for purportedly advising undocumented immigrants on evading ICE agents, which raises legal issues.

Former federal prosecutor Jonathan Fahey remarked that her conduct might be “skirting the line” and could potentially obstruct justice. Tom Homan, a former Trump border official, cautioned that encouraging undocumented immigrants to resist detention might breach federal harboring statutes.

AOC conducted a webinar and distributed flyers detailing methods for illegal immigrants to evade ICE, including guidance on refusing entry without a warrant signed by a judge. Homan has reached out to the DOJ to ascertain whether her actions amount to criminal “impediment,” which could result in felony charges. An investigation is currently in progress.
