Edward Chen, a U.S. District Court judge from California appointed by former President Barack Obama, asserted that the economic contributions of migrants afford them legal status that is separate from American political and legal frameworks.
He noted that migrants possess higher educational attainment than the majority of U.S. citizens, with 40-54% holding bachelor’s degrees, and exhibit greater labor participation rates, ranging from 80-96%, largely due to their younger average age. Furthermore, they contribute billions of dollars annually to the U.S. economy and pay hundreds of millions, if not billions, in Social Security taxes, as indicated in the order.
This exemplifies what is referred to as judicial tyranny. President Biden has significantly increased the influx of illegal immigrants from Venezuela, including individuals with criminal backgrounds, and has provided them with welfare benefits and social security numbers. President Trump was elected on a platform that promised to halt this invasion. A rogue Marxist judge has now mandated the continuation of Biden’s amnesty program,” stated Stephen Miller, who serves as Trump’s policy chief.
The judge’s ruling has obstructed Trump’s plan to terminate Temporary Protected Status (TPS) next month, arguing that enforcing American laws would cause suffering for the illegal migrants: “The court determines that the actions of the Secretary pose a threat of irreparable harm to hundreds of thousands of individuals, disrupting their lives, families, and livelihoods. This would result in billions of dollars in lost economic activity for the United States and compromise public health and safety across communities nationwide.”
Simultaneously, the government did not establish any substantial countervailing harm associated with the continuation of TPS for Venezuelan beneficiaries. The plaintiffs have also demonstrated a strong likelihood of success in proving that the actions taken by Secretary Kristi Noem are unlawful, arbitrary, and capricious, as well as driven by unconstitutional bias. Consequently, the court has granted the plaintiffs’ request to delay the actions until the merits of this case are adjudicated, the judge stated.
The influx of 530,000 migrants into the United States has led to a rise in housing costs and a decline in wages for American families. This situation has created increased economic strain, which may hinder the establishment of new families and the birth of American children.
Furthermore, some Venezuelan migrants have been implicated in violent crimes against Americans, such as the murder of Laken Riley, suggesting that their ongoing presence could lead to further criminal activity targeting ordinary citizens.
Among these migrants are individuals affiliated with the criminal gang Tren de Aragua, known for their involvement in various crimes nationwide, including the takeover of at least one apartment complex in Aurora, Colorado.
The judge is entirely ignoring the law… this is a judge who aspires to be president instead of fulfilling his duties as a judge, stated John Miano, an attorney specializing in immigration matters. The TPS statute clearly states: ‘No judicial review shall be permitted regarding any decision made by the Attorney General concerning the designation, termination, or extension of a designation of a foreign state under this subsection.’
Miano asserts that senior judges from circuit courts, appellate courts, and the U.S. Supreme Court ought to issue directives to restrain the errant judge. He emphasized that part of their responsibility is to supervise the lower judges in the nation.
“They are reluctant to take action because they wish to maintain that unchecked legal authority for themselves. Consequently, the circuit courts hesitate to reprimand lower judges, fearing retaliation from the Supreme Court,” Miano stated. “Their failure to manage lower judges contributes to the disorder within the judicial system,” he further remarked.
The case in question is National TPS Alliance v. Kristi Noem, Case No. 25-cv-01766-EMC, in the U.S. District Court for the Northern District of California.
