The order allowed the government to retry the case if it moves forward, but no justice publicly objected, The Hill\u00a0<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5657340-supreme-court-immigration-judges-speech-emergency-docket\/\" target=\"_blank\" rel=\"noopener\">reported<\/a>.<\/p>\n<p>\u201cAt this stage, the Government has not demonstrated that it will suffer irreparable harm without a stay,\u201d the one-paragraph order reads.<\/p>\n<p>Restrictions on what immigration judges may say in public are the root of the case. The limitations mandate that judges, who are members of the executive branch, get permission before making speeches on topics directly related to their official responsibilities.<\/p>\n<div class=\"code-block code-block-2\">\n<div id=\"e1c09a52-67a1-44a3-a58e-fc2bf67380c6\" class=\"_ap_apex_ad\"><\/div>\n<\/div>\n<p>According to the National Association of Immigration Judges (NAIJ), the policy is unconstitutional under the First Amendment.<\/p>\n<p>However, those free speech issues had not yet presented themselves to the justices.<\/p>\n<div class=\"code-block code-block-7\">Advertisement<\/div>\n<p>The Trump administration appealed to the Supreme Court in an attempt to block an order permitting the lawsuit to proceed before a federal district judge. The administration contends that it needs to appear before the Merit Systems Protection Board (MSPB), a specialized tribunal that handles specific disputes involving federal employees.<\/p>\n<p>That question also raises broader implications for the cases of other federal employees. Solicitor General D. John Sauer informed the justices that the lower decision would \u201cindefinitely thwart the MSPB.\u201d<\/p>\n<p>\u201cThe answer to such prolific contravention of the Court\u2019s precedents should not be to wait and see just how much instability will ensue,\u201d Sauer wrote in court filings.<\/p>\n<div class=\"code-block code-block-10\">Advertisement<\/p>\n<div id=\"as6078\" data-title=\"You Might Also Like\"><\/div>\n<\/div>\n<p>The MSPB\u2019s jurisdiction was recognized by the lower court. It cited President Trump\u2019s dismissal from the board, which left it temporarily without a quorum, as justification for permitting the lawsuit to move forward, stating that it raises \u201cserious questions\u201d about whether the MSPB \u201ccontinues to function as intended.\u201d<\/p>\n<p>\u201cThe Supreme Court was right to reject the government\u2019s request for a stay of proceedings,\u201d Ramya Krishnan, senior staff attorney at the Knight First Amendment Institute, which represents NAIJ, said in a statement.<\/p>\n<p>\u201cIt should also quickly reject the government\u2019s soon-to-be filed cert petition,\u201d Krishnan said, referring to the administration\u2019s expected ask that the justices take up the case on their normal docket. \u201cThe restrictions on immigration judges\u2019 free speech rights are unconstitutional and it\u2019s intolerable that this prior restraint is still in place.\u201d<\/p>\n<p>Friday\u2019s order marks a rare loss for President Trump\u2019s administration on the Supreme Court\u2019s emergency docket.<\/p>\n<p>Since Trump took office again, the administration has submitted 32 emergency applications to the justices.<\/p>\n<p>While the president\u2019s detractors claim it shows him acting illegally, the administration claims the startling figure is the consequence of federal district judges going beyond their bounds to thwart Trump\u2019s agenda.<\/p>\n<p>The Supreme Court has nearly consistently sided with the Trump administration in cases decided thus far, but a number of the applications are still pending or were withdrawn.<\/p>\n<div class=\"code-block code-block-12\">\n<div data-delay=\"4000\" data-block=\"12\">\n<div class=\"ai-lazy\" data-code=\"PHNjcmlwdCBhc3luYyBpZD0iQVY2NGJlMjE3YzIwYjE2ZWM0OWIwM2NjYjQiIHR5cGU9InRleHQvamF2YXNjcmlwdCIgc3JjPSJodHRwczovL3RnMS52aWRjcnVuY2guY29tL2FwaS9hZHNlcnZlci9zcHQ\/QVZfVEFHSUQ9NjRiZTIxN2MyMGIxNmVjNDliMDNjY2I0JkFWX1BVQkxJU0hFUklEPTY0ODg4NTQzYzEyMmE1NDQ1MTAwZjlkOCI+PC9zY3JpcHQ+\" data-class=\"Y29kZS1ibG9jaw==\"><\/div>\n<\/div>\n<\/div>\n<p>However, the nation\u2019s highest court delivered a critical immigration decision this week.<\/p>\n<p>A lower court decision that remanded the case for further investigation was upheld by the Supreme Court, which declined to temporarily halt a legal challenge to a Trump administration policy that\u00a0<a href=\"https:\/\/conservativebrief.com\/supreme-court-immigration-97628\/\" target=\"_blank\" rel=\"noopener\">restricts speaking engagements by immigration judges<\/a>.<\/p>\n<p>The justices\u00a0<a href=\"https:\/\/conservativebrief.com\/supreme-court-immigration-97628\/\" target=\"_blank\" rel=\"noopener\">denied<\/a>\u00a0the administration\u2019s request to stop a ruling by the 4th U.S. Circuit Court of Appeals that resurrected a lawsuit filed by the National Association of Immigration Judges in a brief, unsigned ruling.<\/p>\n<p>But the court made it clear that if the trial court proceeds with discovery before the Supreme Court considers whether to take up the case, the government may come back.<\/p>\n<p>A policy that prohibits immigration judges \u201cfrom speaking in their personal capacities about immigration and about the agency that employs them\u201d is at the heart of the dispute, according to the judges\u2019 association.<\/p>\n<\/div>\n<p><button class=\"read-more-btn\">Read More<\/button><\/article>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>\u00a0Getty Images This article may contain commentary which reflects the author&#8217;s opinion.
