I am fighting to stop this blatant attempt to upend our political system,\u201d he said.<\/p>\n<p>He said accusations of racism were \u201cbaseless\u201d and were pushed by Democrats \u201cbecause they are losing.\u201d<\/p>\n<p>Earlier this week, a three-judge panel in Texas ruled against the new map.<\/p>\n<div class=\"code-block code-block-2\">\n<div id=\"e1c09a52-67a1-44a3-a58e-fc2bf67380c6\" class=\"_ap_apex_ad\"><\/div>\n<\/div>\n<p>In a 2 to 1 decision, the panel said Texas acted with racial motivations when it eliminated several majority minority districts and replaced them with Republican-leaning seats.<\/p>\n<p>The court ordered the state to revert to its older map for the 2026 elections.<\/p>\n<p>Circuit Judge Jerry Smith issued a scathing dissent and called the ruling \u201cthe most blatant exercise of judicial activism that I have ever witnessed.\u201d<\/p>\n<p>Justice Samuel Alito quickly put a hold on the lower court\u2019s decision Friday night.<\/p>\n<div class=\"code-block code-block-7\">Advertisement<\/div>\n<p>That move restores the state\u2019s new map while the case continues.<\/p>\n<p>Mr. Paxton outlined several reasons why the Supreme Court should allow Texas to keep using the map, including the justices\u2019 Purcell Principle, which cautions against changing election rules close to voting.<\/p>\n<p>He repeatedly cited Judge Smith\u2019s dissent as a guide for how the high court should rule.<\/p>\n<p>Texas redrew its map after President Donald Trump urged GOP-led states to help strengthen the party\u2019s narrow House majority.<\/p>\n<div class=\"code-block code-block-10\">Advertisement&nbsp;<\/p>\n<div id=\"as6078\" data-title=\"You Might Also Like\"><\/div>\n<\/div>\n<p>The Justice Department also signaled that some of the minority-heavy districts in the current map might no longer pass constitutional scrutiny.<\/p>\n<p>Gov. Greg Abbott, who directed lawmakers to undertake the rare mid-decade redistricting, said the objective was political gain rather than discrimination.<\/p>\n<p>Texas\u2019 move unleashed a wave of responses from other states.<\/p>\n<p>Democrats in California passed a map that could erase five Republican seats, potentially canceling out Texas\u2019 advantage.<\/p>\n<p>Missouri and North Carolina approved maps more favorable to Republicans, while Virginia is moving toward a map that favors Democrats.<\/p>\n<p>If the Supreme Court permits the lower court ruling to stand and blocks Texas\u2019 new map, Democrats would likely gain the upper hand in the national redistricting battle.<\/p>\n<p>The justices gave Texas\u2019 challengers until Monday to respond to the emergency request.<\/p>\n<p>The case raises significant questions about the Voting Rights Act of 1965, a landmark law that Supreme Court precedent has long interpreted as encouraging states to create districts that maximize minority voting power.<\/p>\n<p>Conservatives have argued in recent years that this approach conflicts with the Constitution\u2019s Equal Protection Clause.<\/p>\n<p>The Supreme Court has already heard oral arguments this term in a related case touching on that issue.<\/p>\n<div class=\"code-block code-block-12\">\n<div data-delay=\"4000\" data-block=\"12\">\n<div><\/div>\n<\/div>\n<\/div>\n<p>Texas\u2019 emergency request could offer a preview of how the court may ultimately rule.<\/p>\n<p>Still, Mr. Paxton argued the justices do not need to resolve broader questions about the Voting Rights Act in order to let the new map stand.<\/p>\n<p>Judge Jeffrey Brown, a Trump-appointed district judge, wrote the majority opinion against Texas on Tuesday.<\/p>\n<p>He said Texas had no reason to dismantle the majority minority districts it approved in 2021.<\/p>\n<p>\u201cBy all current appearances, there was no past discrimination in favor of minority coalitions for the state to remedy \u2014 and, therefore, no \u2018strong basis in evidence\u2019 to support the state\u2019s purposeful and predominant consideration of race in the 2025 redistricting process,\u201d he wrote in the 160-page ruling.<\/p>\n<p>Judge Smith delivered a sharp response in his dissent.<\/p>\n<p>\u201cThe main winners from Judge Brown\u2019s opinion are George Soros and [California Gov.] Gavin Newsom.
