{"id":25441,"date":"2025-11-30T07:43:39","date_gmt":"2025-11-30T07:43:39","guid":{"rendered":"https:\/\/cndailynews.store\/?p=25441"},"modified":"2025-11-30T07:43:39","modified_gmt":"2025-11-30T07:43:39","slug":"supreme-court-hands-down-major-ruling-7","status":"publish","type":"post","link":"https:\/\/cndailynews.store\/?p=25441","title":{"rendered":"Supreme Court Hands Down Major Ruling"},"content":{"rendered":"<p><a class=\"image-link\" href=\"https:\/\/madadaily.store\/wp-content\/uploads\/2025\/11\/Snipaste_2025-11-29_11-20-16.png\"><img loading=\"lazy\" decoding=\"async\" class=\"attachment-hitmag-featured size-hitmag-featured wp-post-image\" src=\"https:\/\/madadaily.store\/wp-content\/uploads\/2025\/11\/Snipaste_2025-11-29_11-20-16-735x400.png\" alt=\"\" width=\"735\" height=\"400\" \/><\/a><\/p>\n<div class=\"entry-content\">\n<p>The Supreme Court has given the Trump administration the go-ahead to send a group of immigrants who are being held at a U.S. military base in Djibouti back to South Sudan.<\/p>\n<div class=\"code-block code-block-9\">\n<div id=\"usaunfiltered24.com_responsive_1\" data-google-query-id=\"\">\n<div id=\"google_ads_iframe_\/23293390090\/usaunfiltered24.com\/usaunfiltered24.com_responsive_1_0__container__\"><\/div>\n<\/div>\n<\/div>\n<p>In a brief opinion, the justices affirmed that their prior order, which stayed a federal judge\u2019s ruling in Massachusetts that had restricted the government\u2019s ability to deport immigrants to countries not explicitly named in their removal orders, applies in full to the eight immigrants currently in U.S. custody in Djibouti.<\/p>\n<p>The order came after the high court put a hold on a ruling by U.S. District Judge Brian Murphy. His order said that the federal government could not deport immigrants to \u201cthird countries\u201d (those not named in their removal orders) without first making sure, through a series of safeguards, that the people would not be tortured when they were sent back.<\/p>\n<p>Murphy\u2019s verdict said that the government broke his prior order by trying to send eight individuals to South Sudan. The U.S. has sent home all non-emergency workers from South Sudan, and the State Department says not to go there because of \u201ccrime, kidnapping, and armed conflict.\u201d<\/p>\n<div class=\"code-block code-block-6\">\n<div id=\"usaunfiltered24.com_responsive_2\" data-google-query-id=\"\">\n<div id=\"google_ads_iframe_\/23293390090\/usaunfiltered24.com\/usaunfiltered24.com_responsive_2_0__container__\"><\/div>\n<\/div>\n<\/div>\n<p>The plane that was supposed to take the immigrants to South Sudan instead landed in Djibouti, which is close by. The men have been imprisoned inside a U.S. military post since then.<\/p>\n<div class=\"code-block code-block-10\">\n<div id=\"usaunfiltered24.com_responsive_2\"><\/div>\n<\/div>\n<p>The Trump administration appealed to the Supreme Court to stay Murphy\u2019s order, seeking permission to proceed with \u201cthird country\u201d removals while the legal battle over the practice unfolds.<\/p>\n<p>D. John Sauer, the U.S. Solicitor General, said that Murphy\u2019s \u201cjudicially created procedures are currently wreaking havoc on the third-country removal process\u201d and \u201cdisrupt[ing] sensitive diplomatic, foreign policy, and national-security efforts.\u201d<\/p>\n<div class=\"code-block code-block-11\">\n<div id=\"usaunfiltered24.com_responsive_3\" data-google-query-id=\"\">\n<div id=\"google_ads_iframe_\/23293390090\/usaunfiltered24.com\/usaunfiltered24.com_responsive_3_0__container__\"><\/div>\n<\/div>\n<\/div>\n<p>Lawyers for the immigrants who could be sent back to a third country asked the justices to maintain Murphy\u2019s decision. They stressed that the government might still go through with these deportations, but Murphy\u2019s order \u201csimply requires\u201d the Trump administration \u201cto follow the law\u201d when doing so.<\/p>\n<div class=\"code-block code-block-12\">\n<div id=\"usaunfiltered24.com_responsive_3\"><\/div>\n<\/div>\n<p>Murphy said that his ruling was still in effect after the Supreme Court responded to the Trump administration\u2019s first request.<\/p>\n<p>The Trump administration went back to the Supreme Court and asked the justices to make it clear what power the federal government has to deport the individuals who are now being held in Djibouti. Sauer told the court to move quickly to deal with what he called Murphy\u2019s \u201cunprecedented defiance\u201d of the court\u2019s authority.<\/p>\n<p>The majority of the court\u2019s ruling, which was not signed, said that the \u201cOrder stayed the preliminary injunction in full.\u201d<\/p>\n<p>Justice Sonia Sotomayor and Justice Ketanji Brown Jackson, both of whom are liberals, disagreed with the court\u2019s conservative majority. Justice Elena Kagan, on the other hand, agreed with the court\u2019s conservative majority.<\/p>\n<p>She said that she had disagreed with the Supreme Court\u2019s first decision to allow removals to third countries to go ahead. \u201cBut most of this court saw things differently, and I don\u2019t see how a district court can force compliance with an order that this court has stayed,\u201d she wrote.<\/p>\n<p>Reports say that the eight undocumented immigrants are from Cuba, Vietnam, and Laos.<\/p>\n<p>Sotomayor disagreed, saying, \u201cWhat the Government wants to do, concretely, is send the eight noncitizens it illegally removed from the United States from Djibouti to South Sudan, where they will be turned over to the local authorities without regard for the likelihood that they will face torture or death.\u201d<\/p>\n<p>She said that the court shouldn\u2019t have even thought about the government\u2019s motion since the government should have established its case in the lower courts first.
