This will be the first big immigration policy issue of the term.<\/p>\n<div class=\"code-block code-block-1\"><\/div>\n<p>The government must process asylum seekers who arrive at ports of entry, according to federal legislation. But in 2018, President Donald Trump\u2019s first administration started a strategy called \u201cmetering.\u201d Under this policy, border officials would turn away those who wanted to seek asylum and send them back to Mexico before they could enter the US.<\/p>\n<p>A nonprofit that fights for immigrants\u2019 rights, Al Otro Lado, and several asylum seekers sued in California to stop the program. The migrants won in an appeals court in San Francisco, and the Trump administration appealed to the Supreme Court in July.<\/p>\n<p>At least for now, the lawsuit doesn\u2019t have much of an effect on the real world. The Biden administration got rid of \u201cmetering\u201d in favor of less strict rules that many said made the border situation worse.<\/p>\n<div class=\"code-block code-block-2\">Advertisement<\/div>\n<p>But the Trump administration didn\u2019t agree with that rationale. They told the Supreme Court that \u201cthis administration and future administrations should keep the option of reviving that practice when border conditions justify doing so.\u201d<\/p>\n<div class=\"code-block code-block-7\">Advertisement<\/div>\n<p>In that way, the Supreme Court\u2019s decision to consider the case was already a victory for Trump, CNN\u00a0<a href=\"https:\/\/www.cnn.com\/2025\/11\/17\/politics\/supreme-court-trump-asylum-seekers?utm_source=cnn_Breaking+News&amp;utm_medium=email&amp;bt_ee=wgVR4NWNM73FDd1Z37rF7OkY%2F8pfXmF0sy%2B9%2BXYq9TrzDjK7CdUKE%2BnLGvQ2oJqX&amp;bt_ts=1763392236066\" target=\"_blank\" rel=\"noopener\">noted<\/a>.<\/p>\n<p>The 9th US Circuit Court of Appeals, which is split, said that federal law says that border agents must check asylum seekers who arrive at ports of entry, even if they didn\u2019t cross the border. The Trump administration said in its appeal to the high court that this can\u2019t be right.<\/p>\n<p>\u201cIn ordinary English, a person \u2018arrives in\u2019 a country only when he comes within its borders,\u201d US Solicitor General D. John Sauer told the court. \u201cAn alien thus does not \u2018arrive in\u2019 the United States while he is still in Mexico.\u201d<\/p>\n<div class=\"code-block code-block-10\">Advertisement<\/div>\n<p>But the groups supporting Al Otro Lado said that reading would make a mockery of the asylum process, empowering officials to render \u201cinspection and asylum processing requirements wholly inoperable at ports of entry \u2013 the designated places where noncitizens may lawfully come into the United States \u2013 by simply blocking asylum seekers from stepping on U.S. soil.\u201d<\/p>\n<p>Next year, the court will hear arguments in the case and make a ruling by the end of June.<\/p>\n<p>The nation\u2019s highest court has been busy lately.<\/p>\n<p>The U.S. Supreme Court approved the Trump administration\u2019s request to pause a lower court injunction that had\u00a0<a href=\"https:\/\/conservativebrief.com\/supreme-court-greenlight-2-96659\/\">blocked deportations of individuals to third countries<\/a>\u00a0without prior notice.<\/p>\n<p>The decision marks a\u00a0<a href=\"https:\/\/conservativebrief.com\/supreme-court-greenlight-2-96659\/\">near-term victory<\/a>\u00a0for the administration as it aims to implement its immigration crackdown swiftly.<\/p>\n<p>The Court ruled\u00a0<a href=\"https:\/\/conservativebrief.com\/supreme-court-greenlight-2-96659\/\">6-3 in favor of staying the injunction<\/a>, with Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson dissenting.<\/p>\n<div class=\"code-block code-block-12\">\n<div data-delay=\"4000\" data-block=\"12\">\n<div>\n<div id=\"e1c09a52-67a1-44a3-a58e-fc2bf67380c6\" class=\"_ap_apex_ad\"><\/div>\n<\/div>\n<\/div>\n<\/div>\n<p>The case involved a group of migrants contesting their deportations to third countries\u2014nations other than their countries of origin.<\/p>\n<div class=\"code-block code-block-13\">\n<div id=\"as6078\" data-title=\"You Might Also Like\"><\/div>\n<\/div>\n<p>Earlier this month, lawyers representing these migrants urged the Supreme Court to uphold a ruling by U.S. District Judge Brian Murphy, who had ordered the Trump administration to keep all migrants facing deportation to third countries in U.S. custody until further review.<\/p>\n<p>Murphy, based in Boston, oversaw a class-action lawsuit brought by migrants challenging deportations to countries such as South Sudan, El Salvador, Costa Rica, Guatemala, and others that the administration has reportedly considered in its ongoing deportation efforts.<\/p>\n<p>Murphy ruled that migrants must stay in U.S. custody until they have the opportunity to undergo a \u201creasonable fear interview,\u201d allowing them to explain to U.S. officials any fears of persecution or torture if released into the country.<\/p>\n<\/div>\n<div class=\"code-block
