Department of Homeland Security, et al.<\/em><\/p>\n<p>The case led to a 2022 settlement that constrained how ICE conducts warrantless \u201ccollateral\u201d arrests in the agency\u2019s Chicago Field Office region (Illinois, Indiana, Wisconsin, Missouri, Kentucky, and Kansas). Cummings claimed that he found \u201crepeated, material\u201d violations by ICE and extended court supervision into 2026.<\/p>\n<div class=\"code-block code-block-2\">Advertisement<\/div>\n<p>The ruling comes amid the administration\u2019s push to accelerate removals and to stage larger operations near federal facilities, including courthouses. Homeland Security said it will comply with lawful orders but warned the decision makes it harder to remove individuals with final orders and to secure federal buildings and personnel during volatile protests.<\/p>\n<p>The opinion\u2019s most consequential pieces for enforcement are procedural. Cummings reaffirmed that under 8 U.S.C. \u00a7 1357(a)(2), warrantless immigration arrests require not only probable cause that a person is removable but also contemporaneous facts showing the individual is \u201clikely to escape before a warrant can be obtained.\u201d<\/p>\n<div class=\"code-block code-block-7\">Advertisement<\/p>\n<div id=\"as5808\" data-title=\"You Might Also Like\"><\/div>\n<\/div>\n<p>The court said ICE must document that \u201clikelihood of escape\u201d at the time of the arrest\u2014on Form I-213\u2014and must document it as soon as practicably possible. He ordered ICE to re-broadcast that policy to all officers, obtain written acknowledgments, and produce ongoing reports.<\/p>\n<p>Cummings also rejected ICE\u2019s recent practice of having field supervisors generate administrative arrest warrants (Form I-200) on the spot for collateral encounters, without first issuing a Notice to Appear (NTA). Citing 8 C.F.R. \u00a7\u00a7 236.1(b) and 1236.1(b), he said I-200 warrants are tied to the charging process and cannot be used as a workaround to avoid the statute\u2019s warrantless-arrest limits.<\/p>\n<div class=\"code-block code-block-10\">Advertisement<\/div>\n<p>The judge\u2019s order extends the consent decree in the case until Feb. 2, 2026, specifically to make up for the period in 2025 when the court found ICE \u201cunequivocally ceased compliance.\u201d The opinion notes that on June 11, 2025, ICE\u2019s principal legal advisor emailed staff declaring the settlement \u201cterminated,\u201d despite a still-pending enforcement motion.<\/p>\n<p>The court disagreed, kept the decree alive, and is now requiring monthly data dumps from ICE\u2019s Operations Management Module showing all qualifying arrests in the Northern District of Illinois.<\/p>\n<p>Cummings also granted relief in 22 of 26 sample cases presented by plaintiffs, finding those arrests violated the agreement.<\/p>\n<p>One cluster\u2014dubbed \u201cthe Liberty 12\u201d\u2014involved a February 2025 sweep at a Missouri restaurant where employees were seated under guard, exits monitored, and one worker cuffed and removed; the judge concluded a reasonable person would not have felt free to leave and that the contemporaneous I-213 narratives did not show a likelihood of escape.<\/p>\n<p>In another case, the court credited a detainee\u2019s declaration over the I-213 where the form misstated basic facts about residency and ties to the community, underscoring that officers must ask and record those factors at the scene if they intend to rely on U.S. Code.<\/p>\n<div class=\"code-block code-block-12\">\n<div data-delay=\"4000\" data-block=\"12\">\n<div><\/div>\n<\/div>\n<\/div>\n<p>The court ordered ICE to reimburse immigration bonds and lift conditions of release for class members arrested contrary to the decree, and to pay plaintiffs\u2019 attorneys\u2019 fees because the government\u2019s position was \u201cnot substantially justified.\u201d It directed remedial training for the officers involved, with proof of completion to be filed with the court. Although the federal government is partially shut down, the opinion notes ICE operations have continued and sets short deadlines for compliance.<\/p>\n<p>The Department of Homeland Security (DHS) said that it intends to \u201ccomply with all lawful court orders and is addressing this matter with the court.\u201d<\/p>\n<p>However, DHS defended its practice of making \u201ccollateral arrests\u201d of illegal alien suspects whenever it is practical.<\/p>\n<p>\u201cWe aren\u2019t some medieval kingdom; there are no legal sanctuaries where you can hide and avoid the consequences for breaking the law,\u201d DHS said in a statement. \u201cNothing in the Constitution prohibits arresting a lawbreaker where you find them.\u201d<\/p>\n<\/div>\n<div class=\"code-block code-block-9\">\n<div id=\"taboola-below-article-thumbnails\" class=\"trc_related_container tbl-feed-container render-late-effect tbl-feed-frame-DIVIDER\" data-feed-container-num=\"1\" data-feed-main-container-id=\"taboola-below-article-thumbnails\" data-parent-placement-name=\"Below Article Thumbnails\" data-pub-lang=\"en\">\n<div id=\"taboola-below-article-thumbnails-sca1\" class=\"trc_related_container tbl-trecs-container trc_spotlight_widget trc_elastic trc_elastic_above-the-feed-premium-card-fp-delta above-the-feed-placement\" data-card-index=\"1\" data-placement-name=\"Below Article Thumbnails | Injected 1\"><\/div>\n<div class=\"tbl-feed-header tbl-logo-right-position tbl-ccpa-container\"><\/div>\n<\/div>\n<\/div>\n<\/article>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>\u00a0Getty Images This article may contain commentary which reflects the author&#8217;s opinion.
