After a US federal appeals court determined that President Donald Trump\u2019s \u201creciprocal\u201d tariffs were illegal, the US\u2019s trading partners are now facing a new period of uncertainty.<\/p>\n

The judges, in a 7-4 vote, said that Trump had gone too far by using emergency powers to put tariffs of \u201cunlimited duration on nearly all goods from nearly every country in the world.\u201d This verdict upheld an earlier court ruling.<\/p>\n

The decision will mess up the plans of trading partners who are still talking to the US, and they may decide to wait and see what happens in the court case.<\/p>\n

There are other ways to fight the ruling, but Trump has made it plain that the next stop will be the Supreme Court.<\/p>\n

The US Court of Appeals for the Federal Circuit decided that the tariffs will stay in effect until October 14 so that more appeals could be made.<\/p>\n

Two important things came out of this new decision.<\/p>\n

First, the \u201cliberation day\u201d taxes are against the law right now. Second, these \u201cillegal\u201d tariffs will stay in place for now so that the different ways to protest can be looked into.<\/p>\n

Under the executive orders in question, money will still be gathered. If the appeals court rules that the tariffs are illegal, that money might have to be refunded.<\/p>\n

This decision does not cover all tariffs. It doesn\u2019t cover taxes on certain industries, like those on steel and aluminum. But other tariffs that Trump put in place during his first term have already been found to be illegal by the World Trade Organization. They are now being appealed through the international dispute settlement system.<\/p>\n

The most recent decision did not overturn the decision to end the de minimis exception, which caused postal chaos around the world. If the decision is confirmed, however, the tariff rates on low-value goods will go back to the percentages they were before \u201cliberation day.\u201d Most of the time, this would mean \u201cback to zero.\u201d<\/p>\n
