John Sauer urged the justices to intervene, arguing that the president\u2019s order was lawful under federal statutes that permit the use of the Guard when \u201crebellion\u201d or \u201cobstruction\u201d prevents enforcement of U.S. law. Sauer\u00a0<a href=\"https:\/\/apnews.com\/article\/supreme-court-national-guard-trump-913ecce44b6bcc5d0cba1b252dfd34ce\" target=\"_blank\" rel=\"noopener\">said<\/a>\u00a0the situation around a U.S. Immigration and Customs Enforcement (ICE) facility in Broadview, Ill., meets that standard.<\/p>\n<div class=\"code-block code-block-2\">Advertisement<\/div>\n<p>\u201cViolent agitators have repeatedly obstructed access to a critical federal immigration facility,\u201d Sauer wrote. \u201cLocal forces have failed to respond, even when federal agents face life-threatening violence.\u201d He said the deployment was necessary to \u201cprotect immigration officers and federal buildings\u201d and to relieve federal agents diverted from other assignments to secure the facility.<\/p>\n<p>The dispute centers on Trump\u2019s use of Section 12406 of Title 10 of the U.S. Code, which allows the president to federalize a state\u2019s National Guard when civil authorities are unable or unwilling to enforce federal law. The administration says that provision justifies the move, while Illinois officials argue it amounts to an unconstitutional use of military force within state borders.<\/p>\n<div class=\"code-block code-block-7\">Advertisement<\/p>\n<div id=\"as5808\" data-title=\"You Might Also Like\"><\/div>\n<\/div>\n<p>U.S. District Judge April Perry, a Biden appointee, rejected Trump\u2019s rationale earlier this month, ruling that \u201cno substantial evidence of rebellion\u201d or obstruction existed in Illinois. The 7th U.S. Circuit Court of Appeals largely upheld her decision, saying that while the president may call up Guard troops, he cannot deploy them without clear proof that state authorities cannot maintain order.<\/p>\n<p>Sauer said the lower courts \u201cindefensibly minimized\u201d the risks faced by immigration officers and failed to show proper deference to the president\u2019s national security authority. He asked the justices to stay the injunction \u201cto prevent further endangerment of federal personnel.\u201d<\/p>\n<div class=\"code-block code-block-10\">Advertisement<\/div>\n<p>The Supreme Court gave Illinois and Chicago until Monday to respond to the government\u2019s request.<\/p>\n<p>The petition marks the latest in a series of cases testing the limits of Trump\u2019s executive power during his second term. The Supreme Court \u2014 which has previously sided with the administration on several emergency matters \u2014 now faces another politically charged decision balancing presidential authority and state sovereignty.<\/p>\n<p>Illinois officials, joined by the city of Chicago, sued to block the deployment last week, arguing that the president was improperly invoking emergency powers to override state control of its National Guard.<\/p>\n<p>\u201cThere is no rebellion here, and no justification for turning Illinois into a militarized zone,\u201d Illinois Attorney General Kwame Raoul said in a statement.<\/p>\n<p>Tensions have risen outside the ICE facility in Broadview, where federal officials say several demonstrations have turned violent. On Friday, police arrested 11 protesters who had attempted to block vehicle access to the complex. Activists accused federal agents of excessive force, citing past use of tear gas and pepper spray on demonstrators.<\/p>\n<div class=\"code-block code-block-12\">\n<div data-delay=\"4000\" data-block=\"12\">\n<div><\/div>\n<\/div>\n<\/div>\n<p>The Illinois case is one of several pending court battles over Trump\u2019s decision to deploy the Guard in response to anti-ICE protests across the country.
