At the center of the debate is a woman who claims she was denied a promotion and later demoted because of her sexual orientation.<\/p>\n<div class=\"code-block code-block-9\">\n<div id=\"usaunfiltered24.com_responsive_1\" data-google-query-id=\"\">\n<div id=\"google_ads_iframe_\/23293390090\/usaunfiltered24.com\/usaunfiltered24.com_responsive_1_0__container__\"><\/div>\n<\/div>\n<\/div>\n<p class=\"\" data-start=\"506\" data-end=\"865\">The case was brought by a former Ohio state employee, identified as Ames, who worked for the Ohio Department of Youth Services for more than 15 years. She alleges that her supervisor, who is gay, passed her over for promotion in favor of less qualified gay candidates. Ames, a straight white woman, believes this treatment constituted unlawful discrimination.<\/p>\n<p class=\"\" data-start=\"867\" data-end=\"1280\">Her claim was initially dismissed by the U.S. Court of Appeals for the Sixth Circuit, which ruled that Ames had failed to meet a legal threshold known as a \u201cprima facie\u201d case\u2014a necessary early showing of potential discrimination under Title VII of the Civil Rights Act of 1964. The lower court cited a lack of \u201cbackground circumstances\u201d suggesting that the employer was biased against members of a majority group.<\/p>\n<p class=\"\" data-start=\"1282\" data-end=\"1631\">Title VII prohibits employment discrimination based on race, color, religion, sex, or national origin. In recent years, courts have expanded the understanding of the law to include protections for sexual orientation and gender identity. Still, proving discrimination against members of majority groups has often required additional burdens of proof.<\/p>\n<div class=\"code-block code-block-6\">\n<div id=\"usaunfiltered24.com_responsive_2\" data-google-query-id=\"\">\n<div id=\"google_ads_iframe_\/23293390090\/usaunfiltered24.com\/usaunfiltered24.com_responsive_2_0__container__\"><\/div>\n<\/div>\n<\/div>\n<p class=\"\" data-start=\"1633\" data-end=\"1987\">However, during Tuesday\u2019s Supreme Court session, there appeared to be rare consensus among the justices. Justice Neil Gorsuch described the situation as one of \u201cradical agreement,\u201d with most of the bench and even the state of Ohio seeming to side with Ames on a key point: that the so-called \u201cbackground circumstances\u201d requirement may not be appropriate.<\/p>\n<div class=\"code-block code-block-10\">\n<div id=\"usaunfiltered24.com_responsive_2\"><\/div>\n<\/div>\n<p class=\"\" data-start=\"1989\" data-end=\"2156\">\u201cWe agree, Ohio agrees, that it\u2019s wrong to treat people differently,\u201d said Ohio Solicitor General Elliot Gaiser in response to Justice Amy Coney Barrett\u2019s questioning.<\/p>\n<p class=\"\" data-start=\"2158\" data-end=\"2343\">Justice Sonia Sotomayor, a member of the court\u2019s liberal wing, remarked that the facts of Ames\u2019 case raised questions. \u201cThere\u2019s something suspicious about what happened here,\u201d she said.<\/p>\n<div class=\"code-block code-block-11\">\n<div id=\"usaunfiltered24.com_responsive_3\" data-google-query-id=\"\">\n<div id=\"google_ads_iframe_\/23293390090\/usaunfiltered24.com\/usaunfiltered24.com_responsive_3_0__container__\"><\/div>\n<\/div>\n<\/div>\n<p class=\"\" data-start=\"2345\" data-end=\"2655\">The high court\u2019s ruling could affect how lower courts handle discrimination claims brought by majority-group plaintiffs. If the justices strike down the \u201cbackground circumstances\u201d requirement, it would lower the initial barrier for individuals in majority demographics to pursue legal recourse under Title VII.<\/p>\n<div class=\"code-block code-block-12\">\n<div id=\"usaunfiltered24.com_responsive_3\"><\/div>\n<\/div>\n<p class=\"\" data-start=\"2657\" data-end=\"2955\">While the justices seemed inclined to give Ames another chance to argue her case, the court\u2019s final decision will determine whether her lawsuit can proceed.
