The justices concluded that when Congress establishes independent regulatory agencies like the FTC, it can shield their officials from removal except in cases of misconduct or other justifiable cause.<\/p>\n<p>In 2021, President Biden appointed three commissioners to the Consumer Product Safety Commission (CPSC), the federal agency responsible for setting safety standards, overseeing product recalls, researching potential hazards, and occasionally banning dangerous products.<\/p>\n<p>However, just months into his new term, President Trump dismissed the Biden-appointed commissioners before their terms had expired.<\/p>\n<p>The commissioners filed a lawsuit in response, arguing that the president could not prematurely end their appointments without cause. Congress designed the consumer protection agency as \u201can independent regulatory commission,\u201d they argued, and according to law, the president could only remove them for \u201cneglect of duty of malfeasance in office.\u201d<\/p>\n<p>The Trump administration contended that the president, as the nation\u2019s chief executive, has the authority to remove commissioners \u201cat will,\u201d arguing that they wield \u201csubstantial or considerable executive power.\u201d<\/p>\n<div class=\"code-block code-block-12\">\n<div data-delay=\"4000\" data-block=\"12\">\n<div><\/div>\n<\/div>\n<\/div>\n<p>A federal judge in Maryland temporarily halted the Trump administration from removing the commissioners and ordered their reinstatement to their previous positions while the case continues in the lower courts.<\/p>\n<p>After the Fourth Circuit Court of Appeals declined to step in, the Trump administration appealed to the Supreme Court, referencing a May ruling in which the justices, in a 6-3 decision, granted an emergency request allowing the administration to remove members of both the National Labor Relations Board and the Merit Systems Protection Board.<\/p>\n<p>On Wednesday, the Court again sided with the administration, NPR added.<\/p>\n<p>In May, the\u00a0<a href=\"https:\/\/conservativebrief.com\/supreme-of-2-91790\/\" target=\"_blank\" rel=\"noopener\">court ruled<\/a>\u00a0that Trump has the authority to fire two Democrat-appointed agency figures, again over the dissent of the high court\u2019s three liberal justices.<\/p>\n<p>However, the justices declined the Trump administration\u2019s request to fast-track the case and fully review it this term, postponing a decision on whether the president has the authority to dismiss the two National Labor Relations Board officials permanently, The Hill reported.<\/p>\n<\/div>\n<\/article>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>\u00a0Getty Images This article may contain commentary which reflects the author&#8217;s opinion.
