The U.S. Supreme Court has ruled that President Trump may, for now, remove President Biden\u2019s three appointees to the Consumer Product Safety Commission without cause.<\/p>\n

The decision marks a further erosion of a 90-year-old precedent intended to safeguard the independence of certain regulatory agencies in deferrence to Executive Branch authority, NPR reported.<\/p>\n

\u201cThe Consumer Product Safety Commission exercises executive power in a similar manner as the National Labor Relations Board, and the case does not otherwise differ from Wilcox in any pertinent respect,\u201d the court said in its order.<\/p>\n

In a concurrent order issued separately, Justice Brett Kavanaugh said he would have granted the case for review this fall, NPR\u00a0added<\/a>.<\/p>\n

All three of the high court\u2019s liberals dissented.<\/p>\n

Justice Elena Kagan, writing on behalf of herself and fellow liberal Justices Sonia Sotomayor and Ketanji Brown Jackson, criticized the majority for using the emergency docket to block Congress from restricting removals without cause. She warned that the decision effectively expands executive power at the expense of congressional authority.<\/p>\n

\u201cThe majority has acted on the emergency docket\u2014with \u2018little time, scant briefing, and no argument\u2019 \u2014 to override Congress\u2019s decisions about how to structure administrative agencies so that they can perform their prescribed duties,\u201d she wrote. \u201cBy means of such actions, this Court may facilitate the permanent transfer of authority, piece by piece by piece, from one branch of Government to another.\u201d<\/p>\n
