The order follows President Trump\u2019s announcement that he planned to send troops to protect what he described as a \u201cwar-ravaged\u201d city.<\/p>\n<div class=\"code-block code-block-1\">\n<div id=\"e1c09a52-67a1-44a3-a58e-fc2bf67380c6\" class=\"_ap_apex_ad\"><\/div>\n<\/div>\n<p>The decision, by U.S. District Judge Karin Immergut \u2014 a Trump appointee \u2014 is the latest in a series of legal setbacks for the administration\u2019s efforts to increase federal intervention in Democratic-led cities experiencing high levels of unrest and crime, CNN\u00a0<a href=\"https:\/\/www.cnn.com\/2025\/10\/04\/us\/what-we-know-portland-chicago-national-guard-deployments\" target=\"_blank\" rel=\"noopener\">reported<\/a>.<\/p>\n<p>In her ruling, Judge Immergut wrote that Oregon and the city of Portland \u201care likely to succeed on their claim that the President exceeded his constitutional authority and violated the\u00a0<a href=\"https:\/\/www.law.cornell.edu\/constitution\/tenth_amendment\" target=\"_blank\" rel=\"noopener\">Tenth Amendment<\/a>.\u201d<\/p>\n<div class=\"code-block code-block-2\">Advertisement<\/div>\n<p>Critics immediately panned the ruling as wrong-headed, noting that\u00a0<a href=\"https:\/\/www.law.cornell.edu\/constitution\/articleii\">Article II, Section 2<\/a>\u00a0of the Constitution names the president as the \u201ccommander in chief of the Army and Navy of the United States, and of the militia of the several states, when called into the actual service of the United States.\u201d<\/p>\n<p>Recent incidents cited by the Trump administration of protesters clashing with federal officers, \u201care inexcusable, but they are nowhere near the type of incidents that cannot be handled by regular law enforcement forces,\u201d the judge claimed in her ruling.<\/p>\n<div class=\"code-block code-block-7\">Advertisement<\/p>\n<div id=\"as5808\" data-title=\"You Might Also Like\"><\/div>\n<\/div>\n<p>The Trump administration \u201cmade a range of arguments that, if accepted, risk blurring the line between civil and military federal power\u2014to the detriment of this nation,\u201d she added.<\/p>\n<p>Her ruling did not seem to consider that local law enforcement in Portland has been essentially banned from assisting federal officers, nor the president\u2019s constitutional role as head of the military. In addition, the Trump administration has never claimed they would be using the military in a law enforcement role, which would be a violation of the Posse Comitatus Act of 1878. Rather, the military\u2019s role would be to provide protection of federal property under siege by left-wing agitators.<\/p>\n<div class=\"code-block code-block-10\">Advertisement<\/div>\n<p>The temporary restraining order is set to expire in 14 days, on October 18. Oregon Attorney General Dan Rayfield, a Democrat, said the state plans to seek an extension of the order.<\/p>\n<p>In a filing submitted Friday, the Trump administration announced its intention to appeal Judge Immergut\u2019s decision to the U.S. Court of Appeals for the Ninth Circuit, CNN reported.<\/p>\n<p>Rayfield said the court\u2019s order returns command of the National Guard to Governor Tina Kotek.<\/p>\n<p>State and city officials praised the ruling on Saturday night, saying it confirms that Portland was not experiencing a rebellion or major unrest in the weeks preceding the Trump administration\u2019s deployment directive.<\/p>\n<p>\u201cToday\u2019s ruling is a healthy check on the president\u2019s power, and as the president, you must have actual facts based on reality, not social media or just your gut feeling, if you want to mobilize the military,\u201d Rayfield claimed.<\/p>\n<p>Oregon\u2019s Democratic governor described the judge\u2019s decision as a \u201ca step in the right direction.\u201d<\/p>\n<div class=\"code-block code-block-12\">\n<div data-delay=\"4000\" data-block=\"12\">\n<div><\/div>\n<\/div>\n<\/div>\n<p>\u201cWe would hope that President Trump respects the court decision and the rule of law,\u201d Kotek said. \u201cWe would hope he reverses course.\u201d<\/p>\n<p>The Trump administration has cited recent unrest in both Portland and Chicago as justification for deploying federal troops to the two Democratic-led cities. Officials have pointed to new waves of protests and the recent arrest of a conservative social media personality as evidence of ongoing instability.<\/p>\n<p>The White House said President Trump has authorized 300 members of the Illinois National Guard to \u201cprotect federal officers and assets\u201d in Chicago.
