These are the same officials who\u2019ve let lawlessness run rampant and now want to block the very measures that could restore order.<\/p>\n<p>Over the weekend, an Oregon judge issued two rulings attempting to stop Trump from deploying any state\u2019s Guard to Portland \u2014 rulings the administration is rightly appealing. Not to be outdone, Illinois jumped in on Monday with its own lawsuit. It\u2019s the same tired story: Democrats would rather protect chaos than admit Trump\u2019s law-and-order approach works.<\/p>\n<p>President Trump\u2019s statement on Monday is sure to send Democrats into full meltdown mode: he\u2019s\u00a0<a href=\"https:\/\/www.nytimes.com\/2025\/10\/06\/us\/trump-insurrection-act-national-guard.html\" target=\"_blank\" rel=\"noopener\">openly considering invoking the Insurrection Act of 1807<\/a>\u00a0to push back against their obstruction:<\/p>\n<blockquote><p><em>In an appearance in the Oval Office in the afternoon, Mr. Trump was asked under what circumstances he would exercise those emergency powers. He blasted the avalanche of lawfare and the barrage of activist court rulings against President Trump as nothing less than a \u201clegal insurrection\u201d:<\/p>\n<blockquote><p><em>His aide Stephen Miller referred to a judge\u2019s order barring, for now, the deployment of National Guard troops in Portland over the objections of local officials as \u201clegal insurrection.\u201d<\/em><\/p>\n<p><em>\u201cThere is an effort to delegitimize the core function of the federal government of enforcing our immigration laws and our sovereignty,\u201d Miller said later in an interview with CNN\u2019s Boris Sanchez on Monday.<\/em><\/p><\/blockquote>\n<p>The Insurrection Act, first enacted in 1807 and later updated in 1871, gives the president the authority to deploy military forces within the United States to restore order when local authorities refuse or fail to act. It\u2019s hardly unprecedented \u2014 in fact, it\u2019s been invoked 30 times throughout American history.<\/p>\n<p>The last use came in 1992, when President George H.W. Bush sent troops to Los Angeles at the request of then-Governor Pete Wilson to stop the riots tearing the city apart (<a href=\"https:\/\/www.brennancenter.org\/our-work\/research-reports\/guide-invocations-insurrection-act\" target=\"_blank\" rel=\"noopener\">full list here<\/a>). And it\u2019s worth remembering that Presidents Dwight Eisenhower and John F. Kennedy both invoked the same law \u2014 against the wishes of defiant governors \u2014 to enforce school desegregation after the Supreme Court\u2019s\u00a0<em>Brown v.
