{"id":14925,"date":"2025-09-27T15:14:39","date_gmt":"2025-09-27T15:14:39","guid":{"rendered":"https:\/\/cndailynews.store\/?p=14925"},"modified":"2025-09-27T15:14:39","modified_gmt":"2025-09-27T15:14:39","slug":"appeals-court-blocks-obama-judges-order-to-close-alligator-alcatraz-in-everglades","status":"publish","type":"post","link":"https:\/\/cndailynews.store\/?p=14925","title":{"rendered":"Appeals Court Blocks Obama Judge\u2019s Order To Close \u2018Alligator Alcatraz\u2019 In Everglades"},"content":{"rendered":"<p>The 11th U.S. Circuit Court of Appeals has paused a lower court ruling that ordered the closure of the Alligator Alcatraz detention facility in the Florida Everglades.<\/p>\n<div class=\"code-block code-block-1\"><\/div>\n<p>U.S. District Judge Kathleen Williams issued the original order last month.<\/p>\n<p>She wrote that she expected the number of inmates to be reduced within 60 days, with many transferred to other prisons.<\/p>\n<p>After that, she said, equipment such as generators, fencing, and lighting would be removed from the site, WOFL\u00a0<a href=\"https:\/\/www.yahoo.com\/news\/articles\/alligator-alcatraz-federal-court-hearing-191932862.html\" target=\"_blank\" rel=\"noopener\">reported<\/a>.<\/p>\n<div class=\"code-block code-block-2\">Advertisement<\/div>\n<p>The lawsuit prompting her ruling came from environmentalists and the Miccosukee Tribe.<\/p>\n<p>They claimed the detention center could damage the Everglades through noise, light, and other pollution.<\/p>\n<p>On Wednesday, the appeals court issued a 2-1 opinion granting the government\u2019s request to put the order on hold while the case continues.<\/p>\n<div class=\"code-block code-block-7\">Advertisement<\/p>\n<div id=\"as5808\" data-title=\"You Might Also Like\"><\/div>\n<\/div>\n<p>\u201cAfter careful consideration we GRANT the Defendants\u2019 motions, and we STAY the preliminary injunction and the underlying case itself pending appeal,\u201d the court wrote.<\/p>\n<p>The panel directly challenged the logic of the lawsuit and Williams\u2019 findings.<\/p>\n<div class=\"code-block code-block-10\">Advertisement<\/div>\n<p>\u201cThe district court specifically noted \u2018light pollution affecting members\u2019 ability to observe the night skies\u2019 and \u2018noise pollution impacting members\u2019 ability to observe and interact with wildlife,\u2019\u201d the judges wrote.<\/p>\n<p>\u201cIn reaching this conclusion, the district court did not mention that, although located in the Big Cypress Reserve near the Everglades, the Site was a working airport with close to 28,000 landings and takeoffs in the prior six months alone, bright lights kept on \u201924\/7,\u2019 and a lack of noise abatement requirements before the sites conversion to a detention center.\u201d<\/p>\n<p>That means the detention facility was not placed randomly in the Everglades; the Trump administration and Florida Gov. Ron DeSantis authorized the use of an existing airport site.<\/p>\n<p>The Department of Homeland Security also responded to the court\u2019s action.<\/p>\n<p>\u201cThis lawsuit was never about the environmental impacts of turning a developed airport into a detention facility,\u201d the agency said in a statement to Reuters.<\/p>\n<p>\u201cIt has and will always be about open borders activists and judges trying to keep law enforcement from removing dangerous criminal aliens from our communities, full stop.\u201d<\/p>\n<p>Williams was nominated to the bench in 2011 by President Barack Obama.<\/p>\n<p>The case will remain on hold while the appeals process continues.<\/p>\n<div class=\"code-block code-block-12\">\n<div data-delay=\"4000\" data-block=\"12\">\n<div>\n<div id=\"e1c09a52-67a1-44a3-a58e-fc2bf67380c6\" class=\"_ap_apex_ad\"><\/div>\n<\/div>\n<\/div>\n<\/div>\n<p>Williams, an Obama appointee, had issued a temporary restraining order citing environmental concerns and the absence of a formal environmental impact statement. Her order suspended housing new detainees at the site and halted construction, forcing transfers of migrants to other detention centers across Florida.<\/p>\n<p>DeSantis celebrated the outcome, calling it a win against judicial interference in immigration enforcement. \u201cThe media was giddy that somehow Alligator Alcatraz was \u2018shutting down,\u2019\u201d DeSantis said. \u201cNow we told them that that wasn\u2019t true. There had been illegal aliens continuing to be there and removed and returned to their home country.\u201d<\/p>\n<p>He accused Williams of overreach by ruling that Florida could not use its own property for immigration enforcement without conducting an environmental review. \u201cSome leftist judge ruled implausibly that somehow Florida wasn\u2019t allowed to use our own property to help the federal government in this important mission because they didn\u2019t do an environmental impact statement,\u201d he said. \u201cWell, we said we would fight that \u2026 and I\u2019m pleased to say that the 11th Circuit Court of Appeals has just stayed that ruling and stayed the case.
